MEMORANDUM ON THE DRAFT CLIMATE CHANGE (NON-MARKET APPROACHES) REGULATIONS 2025

Mt. Kenya Network Forum participated in a critical multi-stakeholder workshop convened by WWF-Kenya, Friedrich-Ebert-Stiftung (FES) Kenya, and Natural Justice to review the Draft Climate Change (Non-Market Approaches) Regulations 2025. Held from March 2–5, 2025, the workshop brought together 20 civil society and environmental organizations to ensure Kenya’s climate policies prioritize equity, transparency, and community-led solutions.

KEY ADVOCACY OUTCOMES

The forum contributed to bold recommendations aimed at strengthening the regulations, including:

  • Inclusive Governance: Pushed for explicit representation of women, youth, persons with disabilities (PWDs), and Indigenous communities in decision-making bodies.
  • Human Rights & Environmental Safeguards: Advocated for mandatory environmental impact assessments (EIAs) and alignment with Kenya’s Climate Change Act and EMCA.
  • Accountability Mechanisms: Proposed annual public reporting and independent oversight to track compliance with climate commitments.

WHY THIS MATTERS FOR MT. KENYA & ARID REGIONS

Non-market approaches (NMAs) — such as ecosystem-based adaptation and community resilience programs — are vital for protecting Mt. Kenya’s water towers, forests, and arid lands from climate impacts. The forum emphasized:

✔ Local Participation: NMAs must involve frontline communities in design and implementation.

✔ Policy Coherence: Regulations should align with Kenya’s National Climate Change Action Plan (NCCAP) and Paris Agreement goals.

NEXT STEPS

The finalized memorandum was submitted to Kenya’s State Department for Environment and Climate Change. The Mt. Kenya Network Forum will continue advocating for:

  • Grassroots Capacity Building: Training communities to lead climate resilience projects.
  • Corporate Accountability: Ensuring polluters fund NMAs through Extended Producer Responsibility (EPR).
